Terms and conditions of NatWest Bank Prize Draw, in partnership with Tourism Malaysia
1. Information on how to enter forms part of the terms and conditions of entry. Entry into the promotion is deemed acceptance of these Terms and Conditions.
2. The promoter is John Brown Magazines Limited (Registered no.
2680403), 136-142 Bramley Road, London W10 6SR (Promoter) & the
sponsor is Tourism Malaysia, Malaysia House, 57 Trafalgar Square, London WC2N 5DU (Sponsor).
3. The promotion ends at midnight on 31 March 2012 (Promotion Period).
4. Subject to clause 5, entry is open only to residents of the United Kingdom and who are 18 years of age as at the date of the Draw (Eligible Entrants).
5. Directors, management, employees and their immediate families of the Royal Bank of Scotland Group of companies, Promoter and the Sponsor and their related bodies corporate and registered travel companions of employees of the RBS Group, Promoter and the Sponsor and its related bodies corporate are not eligible to participate in the promotion or the Draw.
6. To enter, Eligible Entrants must, during the Promotion Period: a. visit
nwsense.com b. go through to the relevant prize draw page, c. register their title, first name, last name, telephone number, email address and residential address, d. read and agree to the promotion Terms and Conditions available on the webpage.
7. Each Eligible Entrant is permitted one entry in the promotion per household where the Entrant normally resides. Multiple entries are not permitted.
8. The Promoter and the Sponsor are not responsible for any problem or technical malfunction of any communications network or any late, lost, incorrectly submitted, delayed, ineligible, incomplete, corrupted or misdirected entry whether due to error, transmission interruption or otherwise.
9. The results of the judging are final and no correspondence will be entered into.
10. The Promoter will draw one prize on 6 April 2012 at the offices of the Promoter (the Draw).
11. There will be one prize. The maximum total prize value is GBP 2,500
based on the recommended retail value and the exchange rate at the time
of printing. The Promoter and Sponsor accept no responsibility for any
variation in the value of the prize.
12. The prize consists of the following holiday for 2 persons to Kuala Lumpur, Malaysia, provided by Tourism Malaysia in association
with Emirates: a. Return economy class flights for 2 persons from UK-Kuala Lumpur, including taxes, fuel charges and seat
reservations. b. Complimentary transfers in Kuala Lumpur. c. 7 nights
hotel accommodation at the Shangri-La Hotel, with bed and breakfast, based on shared double room.
13. Winners need to make their own way to and from the UK airport.
14. The winner of the prize will be notified by telephone, email or
post within seven days of the draw having taken place. If the winner
cannot be contacted by 13 April 2012, the promoter reserves the right
to draw a new winner. The winner’s name and county of residence will be
available on request by calling 020 7565 3216, 21 days after the draw
date. Or, send a SAE to Sense magazine, John Brown Group, 136-142

15. The following booking conditions apply to the prize: a. The prize
must be accepted on the terms offered as set out in these Terms and
Conditions. b. The flights are subject to Emirates' General
Conditions of Carriage and Terms of Business. c. All travel must be
completed by 31 August 2012. d. Once the tickets have been issued, they
cannot be changed e. Prize travel subject to availability at the time of
booking.
16. The prizes do not include travel insurance, passports, visas, meals
(unless where stated in clause 12c), taxes other than those specified in
clause 12, travel to and from the relevant UK airport, or other
ground transportation or any other costs of a personal nature not
specifically stated in these Terms and Conditions and which are the
responsibility of the winner and the winner’s travel companion.
Compliance with any health or other government requirements is the
responsibility of the winner and the winner’s travel companion. Please
note that a valid credit card may be required by hotels as a deposit for
non-inclusive extra costs incurred by the winner or their guest.
17. Each prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated. The prize is not exchangeable or redeemable for cash or other goods or services. The winner and the winner’s travel companion must travel together on all prize flights. A prize cannot be transferred to any other person, unless agreed to by the Promoter and the Sponsor. There can be no changes made to travel arrangements once tickets are issued and tickets will not be exchanged for another destination. Any element of a prize that is unused will be forfeited and no compensation will be paid in lieu of that element of the prize.
18. If any act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and the Sponsor and which prevents the Promoter and/or the Sponsor from complying with these Terms and Conditions, the Promoter and the Sponsor will not be liable for any failure to perform or delay in performing its obligations and the Promoter and Sponsor reserve the right (subject to any applicable law) to cancel, terminate or modify or suspend this promotion.
19. The Promoter, its related bodies corporate and their respective officers, employees, contractors and agents and the Sponsor, its related bodies corporate and their respective officers, employees, contractors and agents (Promotion Parties) will not be liable for any losses, damages, expenses, costs or personal injuries howsoever arising out of this promotion, the promotion of this event or the use of any prize, including but not limited to any breach of these Terms and Conditions, in contract or in tort (including negligence) and any other common law, equitable or statutory remedy (Damages) whatsoever, including but not limited to direct, indirect and consequential Damages, including Damages that cannot reasonably be considered to arise naturally and in the ordinary course of things, even if those Damages were in the contemplation of the Promotion Parties.
20. The exclusion of liability in clause 19 does not apply to limit or exclude liability: a) for personal injury or death suffered or sustained in connection with the supply of goods or services which are supplied by the Promoter or the Sponsor in the ordinary course of business. To remove doubt: third party goods or services, which other than in connection with this promotion, are in the normal course of business supplied by a third party unrelated to the Promotion Parties, are not supplied by the Promoter or the Sponsor in the ordinary course of business; and the Sponsor’s Conditions of Carriage and General Booking Conditions (and any exclusions contained therein) apply despite any statement to the contrary in these terms and conditions; or b) to the extent it is not permissible at law to limit or exclude liability in the manner contemplated in that clause (in which case that liability is limited to the maximum extent allowable by law).
21. The name and photograph of the winner may be used for promotional purposes by the Promoter and the Sponsor.
22. Entry details remain the property of the Promoter, but will be disclosed to the Sponsor on an opt-in basis. Entrants consent to the Promoter using personal information provided in connection with this promotion for the purposes of facilitating the conduct of the promotion, including awarding any prizes. Unless they opt-out, by entering the prize draw entrants also agree to receive targeted offers from the Promoter, Sponsor and their partners from time to time.
